Tester agreement
Effective September 10, 2026
This agreement governs your work as a tester on Appcheckly, operated by Delvir Limited Liability Co.. By accepting a seat you agree to it.
1. Independent contractor
You are an independent contractor, not an employee of Delvir Limited Liability Co.. You set your own hours, use your own device, and take on no exclusivity obligation to us or to any app you test.
2. The review ban
You will not post any public rating, review, comment, or social post about an app you test, on any store or platform, during the cohort or afterwards. Breaching this clause forfeits your completion bonus and any unpaid balance for the affected cohort.
3. No endorsement, no public signal
Your participation is not a review, an endorsement, or a public signal of any kind. Neither you nor the app's creator may present it as one.
4. Pay
Your pay per completed week is published to you before you join and cannot be cut mid-cohort. Your first missed week is forgiven and does not cost your completion bonus. If your cohort's creator stops the cohort mid-way, weeks you already finished are still paid.
You will never be asked for a purchase, a deposit, a top-up, or a fee of any kind. Money only ever moves toward you.
30% of each week's pay is held back and released when you complete the cohort, or forfeited if you do not, per the completion terms shown to you when you accepted the seat. A payout may be clawed back within 7 days of being sent if it is found to be the product of fraud.
5. Identity and one payout account
Before your first payout you confirm your identity once. You may hold exactly one payout destination — one payout account per person — enforced by our systems. This is what keeps seats real and pay from being spread thin.
6. Tax documentation
US persons provide a W-9; everyone else provides a W-8BEN.
7. Confidentiality
Any unreleased build you are given access to, and everything you see or learn while using it, is confidential and stays private. Do not share it, screenshot it publicly, or discuss it outside your weekly report to us.
8. Recordings
Your weekly recordings and screenshots are licensed to Delvir Limited Liability Co. and shared with the creator of the app you tested, and with nobody else.
9. Warranty disclaimer
Appcheckly is provided "as is" and "as available," without warranty of any kind, express or implied.
10. Limitation of liability
To the fullest extent permitted by law, Delvir Limited Liability Co.'s total liability to you is capped at the amounts paid to you in the twelve months preceding the claim. Neither party is liable for indirect, incidental, special, consequential, or punitive damages.
11. Indemnification
You agree to indemnify Delvir Limited Liability Co. against any claim arising from your misuse of the service or your breach of this agreement.
12. Claim limitation and class-action waiver
Any claim under this agreement must be brought within one year of when it arose, in an individual capacity only and not as part of any class, consolidated, or representative action.
13. Governing law and venue
This agreement is governed by the laws of the State of Wyoming. Disputes not eligible for small-claims court will be brought exclusively in the state or federal courts located in Wyoming. Claims within the jurisdictional limit of small-claims court may be brought there instead. Appcheckly does not use arbitration.
14. Severability
If any provision of this agreement is found unenforceable, the rest remains in force.
15. Changes
We may update this agreement from time to time. Material changes take effect no earlier than 30 days after posting, and the effective date above will change.
