Terms of service

These terms govern a creator organization's use of Appcheckly, operated by Delvir Limited Liability Co.. By opening a cohort you agree to them.

1. What is sold

Appcheckly sells testing data over time: structured weekly reports from real people using your app, confirmed against your own product events. Appcheckly makes no promise of ratings, reviews, installs, downloads, rankings, or growth of any kind, and none may be inferred from anything in this service or its marketing.

2. What you may not do with a tester's participation

You are barred from using tester counts, tester activity, or cohort participation as a public growth, popularity, or traction metric. You must not contact testers directly, must not attempt to identify them, and must not ask a tester for a review, a rating, or any public post about your app.

3. Access and integration

You provide access to your app yourself — a promo code, a TestFlight link, or a closed test opt-in — and it must never require a tester to pay for anything. The event data you send us is limited to what the ingest endpoint accepts and must contain no personal data about the person using your app.

4. Billing, credit and the one cash refund

Cohorts are prepaid. A week that does not clear the activity gate, or that a seat misses because no replacement became active within 72 hours, is not billed to you: it converts automatically to platform credit. Credit does not expire and can be spent on any cohort, any tier, at any time. The single cash-refund condition: if the same seat misses the 72-hour replacement promise twice, the remaining weeks on that seat are refunded in cash on request from your cohort dashboard. No other cash refunds are available; the work behind a confirmed week was performed and paid for.

5. Fifteen percent over-seating

On cohorts of eight weeks or longer we staff additional seats, at our own cost, above your seat count. Over-seats are never billed to you and never appear in your seat counts.

6. Warranty disclaimer

Appcheckly is provided "as is" and "as available," without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of liability

To the fullest extent permitted by law, Delvir Limited Liability Co.'s total liability arising out of or relating to this service is capped at the amounts you paid us in the twelve months preceding the claim. Neither party is liable for any indirect, incidental, special, consequential, or punitive damages.

8. Indemnification

You agree to indemnify and hold Delvir Limited Liability Co. harmless from any claim arising from your misuse of the service, your app, or your violation of these terms.

9. Claim limitation and class-action waiver

Any claim arising out of these terms must be brought within one year of when it arose. Claims may be brought only in an individual capacity and not as part of any class, consolidated, or representative action.

10. Governing law and venue

These terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. Any dispute not eligible for small-claims court will be brought exclusively in the state or federal courts located in Wyoming, and each party consents to that venue. Claims within the jurisdictional limit of small-claims court may be brought there instead. Appcheckly does not use arbitration.

11. Severability

If any provision of these terms is found unenforceable, the remaining provisions continue in full force.

12. Changes

We may update these terms from time to time. Material changes take effect no earlier than 30 days after posting, and the effective date above will change.
